3750-15-05. Public notice of proposed rules.

(A) The commission shall follow the procedures specified in this rule and section 119.03 of the Revised Code in giving public notice as to the adoption, amendment, or rescission of rules.

(B) As used in this chapter and as defined in division (C) of section 119.01 of the Revised Code, "rule" means any rule, regulation, or standard, having a general or uniform operation, adopted or promulgated, and enforced by the commission.

(C) Public notice of the intention of the commission to consider adopting, amending or rescinding a rule shall be published in the register of Ohio in accordance with the requirements in Ohio Revised Code 119.03 at least thirty days prior to the date set for a public hearing to consider adopting, amending, or rescinding said rule(s). The said notice shall include:

(1) A general statement of the commission's intention to consider adopting, amending or rescinding the rule;

(2) A synopsis or general statement of the subject matter of the proposed rule, amendment, or rule to be rescinded by the commission;

(3) A statement of the reason or purpose for adopting, amending or rescinding the rule;

(4) The date, time, and place of the public hearing on the proposed rule.

(D) Public notice of the adoption, amendment, or rescission by the commission of final rules shall be published in the register of Ohio in accordance with the requirements in Ohio Revised Code 119.03 at least ten days prior to the effective date of the said rule, except when the governor, pursuant to division (F) of section 119.03 of the Revised Code, declares an emergency allowing for the immediate adoption, amendment, or rescission of a rule. In such a case, the commission shall, as expeditiously as is practical following the adoption, amendment, or rescission of an emergency rule, publish the public notice of such action in the register of Ohio.

(E) The commission shall provide notice to each committee through its designated information coordinator. The commission shall take such additional steps as are reasonably determined to inform interested persons of the time, date, and place of the public hearing.

(F) Copies of the full text of the proposed rule, amendment, or rule to be rescinded shall be available at least thirty days prior to the date set for a public hearing by the commission for any person who wishes to obtain such copies.
